For what he did at age NINE? I highly doubt it, especially if the molesting stopped. He was a child himself, and by any reasonable standards didn’t have the mental and/or emotional capacity to be legally responsible.
He’s best off to take care of this burden regardless of what the law may do, as guilt or uncertainty can wreak further emotional havoc in his life.
